1. Use of
the Net-Portfolio.co.uk Site
Net-Portfolio.co.uk is provided for your use subject to
these Terms and Conditions. By using the Net-Portfolio.co.uk site you agree to
be bound by these Terms and Conditions.
Please note that Net-Portfolio.co.uk has created certain
areas of the site that may contain adult or mature content such as artistic nude style work etc. You must be at
least 18 years of age to access and view such areas.
2. Amendments
We may update these Terms and Conditions from time to
time and any changes will be notified to you via the e-mail address provided by
you on registration or via a suitable announcement on the Net-Portfolio site.
The changes will apply to the use of the Net-Portfolio after we have given
notice. If you do not wish to accept the new Terms and Conditions you should
not continue to use the Net-Portfolio site. If you continue to use the
Net-Portfolio site after the date on which the change comes into effect, your
use of the Net-Portfolio site indicates your agreement to be bound by the new
Terms and Conditions.
3. Registration
You must ensure that the details provided by you on
registration or at any time and correct and complete.
4. Password
and Security
When you register at Net-Portfolio.co.uk you will be
asked to create a password. You must keep this password confidential and must
not disclose it or share it with anyone. You will be responsible for all
activities that occur or are submitted under your password. If you know or
suspect that someone else knows your password you should notify us by contacting
us immediately.
If Net-Portfolio has reason to believe that there is
likely to be a breach of security or misuse of the Net-Portfolio.co.uk site, we
may require you to change your password or we may suspend your account in
accordance with paragraph 9
below.
5. Excluded
Services
The services provided by the Net-Portfolio.co.uk site do
not include the provision of computer or other necessary equipment to access
the Net-Portfolio.co.uk site. To use the Net-Portfolio.co.uk site you will require
Internet connectivity and appropriate telecommunication links. We shall not be
liable for any telephone or other costs that you may incur.
6. Copyright
The content of the Net-Portfolio site is protected by
copyright, trademarks, database and other intellectual property rights. You may
retrieve and display the content of the Net-Portfolio site on a computer
screen, store such content in electronic form on disk (but not any server or
other storage device connected to a network) or print one copy of such content
for your own personal, non-commercial use, provided you keep intact all and any
copyright and proprietary notices. You may not otherwise reproduce, modify,
copy or distribute or use for commercial purposes any of the materials or
content on the Net-Portfolio site without written permission from
Net-Portfolio.co.uk.
No licence is granted to you in these Terms and
Conditions to use any trade mark of Net-Portfolio.co.uk.
7. Limitations
You may not use the Net-Portfolio site for any of the
following purposes:

libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise
objectionable material

Transmitting material that encourages
conduct that constitutes a criminal offence, results
in civil liability or otherwise breaches any relevant laws, regulations or code

computer systems
·
Interfering with any other person’s use or
enjoyment of the Net-Portfolio.co.uk site

Breaching any laws concerning the use of
public telecommunications networks
·
Making, transmitting or storing electronic
copies of materials protected by copyright without permission of the owner.
Net-Portfolio.co.uk reserves the right to refuse to post
material on the Net-Portfolio site or to remove material already posted on the
Net-Portfolio.co.uk site.
8. Availability
of the Net-Portfolio.co.uk site
Although Net-Portfolio aims to offer you the best
service possible, Net-Portfolio.co.uk makes no promise that the services at the
Net-Portfolio site will meet your requirements. Net-Portfolio cannot guarantee
that the service will be fault free. If a fault occurs in the service you
should report it to us by email to admin@net-portfolio.co.uk and
we will attempt to correct the fault as soon as we reasonably can.
Your access to the Net-portfolio.co.uk site may be
occasionally restricted to allow for repairs, maintenance or the introduction
of new facilities or services. Net-Portfolio.co.uk will attempt to restore the
service a soon as it reasonably can.
9. Net-Portfolio.co.uk’s right to suspend or cancel your
registration
Net-Portfolio.co.uk may suspend or cancel your
registration immediately at our reasonable discretion or if you breach any of
your obligations under these Terms and Conditions.
You can cancel this agreement at any time by emailing us
at admin@net-portfolio.co.uk. If
you do so, you must stop using the Net-Portfolio.co.uk site.
Paragraphs 6 and 7 of these Terms and Conditions shall
survive cancellation.
10. Net-Portfolio.co.uk’s Liability
The Net-Portfolio.co.uk site is provided by
Net-Portfolio without any warranties or guarantees. You must bear the risks
associated with the use of the Internet.
The Net-Portfolio site provides content from other
Internet sites or resources and while Net-Portfolio.co.uk tries to ensure that
the material included on the Net-Portfolio site is correct, reputable and of
high quality, it cannot accept responsibility if this is not the case.
Net-Portfolio.co.uk will not be responsible for any errors or omissions or for
the results obtained from the use of such information or for any technical
problems you may experience with the Net-Portfolio.co.uk site. If Net-Portfolio.co.uk
is informed of any inaccuracies in the material on the site we will attempt to
correct the inaccuracies as soon as we reasonably can.
In particular, we disclaim all liabilities in connection
with the following:

data) or any other indirect, special or punitive damages whatsoever that arise
out of or are related to the Net-Portfolio.co.uk site.
11. Third
Party Websites
As a convenience to Net-Portfolio.co.uk users and
customers, the Net-Portfolio.co.uk site may include links to other web sites or
material which are beyond its control. Net-Portfolio.co.uk is not responsible
for content on the Internet or World Wide Web pages outside the
Net-Portfolio.co.uk site.
12. Advertising
and Sponsorship
Part of the Net-Portfolio.co.uk site may contain
advertising and sponsorship. Advertisers and Sponsers
are responsible for ensuring that material submitted for inclusion on the
Net-Portfolio.co.uk site complies with relevant laws and codes. We will not be
responsible for any error or inaccuracy in advertising and sponsorship
material.
13. Applicable
Law
These Terms and Conditions shall be governed by and
construed in accordance with the laws of England and any disputes will be
decided by the English courts.
14. International
Use
Net-Portfolio.co.uk makes no promise that materials on
the Net-Portfolio.co.uk site are appropriate or available for use in locations
outside the United Kingdom, and accessing the Net-Portfolio.co.uk site from
territories where its contents are illegal or unlawful is prohibited. If you
choose to access this site from locations outside the United Kingdom, you do so on your own initiative and responsible for compliance with
local laws.
15. Use of
Community Sites
Net-Portfolio.co.uk allows users to interact with each
other via message boards, and other user forums. We advise you not to post or
in any way reveal any of your personal details on the community sites (for
example, your address or bank information.
You may not use the Community Sites for any of the
following purposes:

disseminating any unlawful, harassing, libellous, defamatory, racially
offensive, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable
material;

transmitting material that encourages conduct that constitutes a
criminal offence, results in civil liability or otherwise breaches any relevant

transmitting material containing any form of advertising or promotion
for goods and services, junk mail, chain letters or "spam";

gaining unauthorised access to other computer systems;
·
interfering with any other person's use or enjoyment of the Community
Sites;
·
making or transmitting or storing electronic copies of materials
protected by copyright without the permission of the owner;
·
impersonating another person;
·
referring to specific website addresses outside of Net-Portfolio.co.uk;
or
·
advertising
16. Net-Portfolio.co.uk does
not control the content placed on the Community Sites. However, Net-Portfolio reserves the right to refuse to post
material, to remove material posted on the Community Sites and to contact you
in the event that there are concerns about the content you have added to a
Community Site. Net-Portfolio may review or edit the content of the Community
Sites. Therefore, if you have concerns about any of the content of the
Community Site you should contact us by selecting the “report abuse” button. The relevant content may be removed from the
Community Sites. If we believe that any material placed on the Community Sites
by you is unlawful we may contact the relevant authority.
Net-Portfolio.co.uk makes no representations
as to the validity of any opinion, advice, information or statement displayed
on the message boards by third parties. You are solely responsible for the
content of your messages posted on the message boards and the views expressed
by individuals do not represent the views of Net-Portfolio.co.uk.
You will be
responsible for:

any claim by any third party that the
use of the Community Sites by you is defamatory, offensive or abusive, or of an
obscene or pornographic nature, or is illegal or constitutes a breach of any
applicable law, regulation or code of practice;
·
any claim by any third party that the
use of the Community Sites by you infringes that third party's copyright or
other intellectual property rights of whatever nature;
·
any fines or penalties imposed by any
regulatory, advertising or trading body or authority in connection with the use
of the Community Sites by you.
You will be
responsible for our losses and costs resulting from your breach of these
Community Sites terms and conditions.
17. Competitions and Prizes
These rules apply to all prize
promotions including free draws, prize competitions and instant win offers.
17.1. From time to time
Net-Portfolio.co.uk will run competitions, free prize draws and promotions on
this website. These may be subject to additional terms that will be made
available at the time.
17.2. Promotions are open to UK
residents aged 18 and over.
17.3. Prizes are non-transferable,
non-negotiable and no cash alternatives will be offered unless stated in the
individual competition rules.
17.4. Net-Portfolio.co.uk and the
promoter reserve the right to substitute the prize for another prize of equal
value.
17.5. NO PURCHASE NECESSARY to
enter the competitions unless otherwise stated on the promotional activity with
a specific competition.
17.6. By entering the prize draw,
the entrant agrees to be bound by the rules and by any other requirements set
out in the promotional material accompanying the promotion. 17.7. By entering
the promotion, the entrant agrees to the terms of the privacy policy.
17.8. It is assumed that by
entering competitions which, if won, could result in time off work, your
employer is in agreement to time off. When dates are specified they can not be altered.
17.9. Winners notified shall have
five (5) business working days to respond in full to the email or another
winner will be drawn.
17.10. By entering the promotion,
the winner(s) consent to any publicity generated as a result of the promotion,
and use on websites, or any advertising
campaign.
17.11. Prize draws are open to all
residents of the UK, except employees of Net-Portfolio.co.uk, the promoter and
their immediate families, the promoters advertising agency and sales promotion
consultancy, and anyone else connected with the creation and administration of
the promotion.
17.12. The Sites' Editors' decision
is final and no correspondence will be entered into. Odds of winning depend on
the number of eligible entries received.
17.13 Only one entry per person.
Spammers will be disqualified.
17.14. Net-Portfolio.co.uk will not
accept responsibility for lost through technical fault, incomplete, illegible
or other damaged entries. Proof of entry is not automatically proof of receipt.
17.15. The promotional draws are
held by Net-Portfolio.co.uk or the promoter, as stated.
17.16. Details of the winner(s) can
be obtained by sending a SAE to Net-Portfolio within 21 days of the closing
date of the competition. Please email us if you wish to do this. Details provided are the winners
full name and locality (not full address or contact details). By entering the
competition, you agree to this information being given out upon request.
17.18. These terms and conditions
shall be governed by and construed in accordance with the laws of England and
Wales.
18 Payment Terms
18.1 The terms and conditions below govern the sale of services from
Net-Portfolio ("the Company") to you ("the Customer"). The
Terms and Conditions above will also apply to premium (paying) members.
19 Main Terms
19.1 The price payable for the service/subscription levels is set out on
the web site and at the time the Customer places their order with us.
19.2 In the case of a change of price, the Company will always contact
the Customer first to ensure that the price is acceptable.
20 Tax Charges
20.1 All prices shown are in pounds
sterling and exclude VAT. (UK sales tax @
17.5%)
21 Subscription Terms and Conditions
21.1 We reserve the right to refuse a subscription which we may judge as
unfit due to content or otherwise. This includes, but is not limited by, a
profile containing adult oriented material such as pornography, profiles which
promote hatred towards persons belonging to any ethnic group, religion or
sexual orientation and profiles which infringe copyright or are contrary to UK
laws.
21.1b Members are not permitted to promote or advertise in any way activities that involve sexual contact between photographers and models as part of shoots (often termed "gonzo" or "point of view"). In addition Members are also not permitted to promote or advertise for work that includes sexual contact between male and female; whether clothed or un-clothed. Members who engage in these styles of work or activities, through the forums or the internal messaging system, will have their memberships cancelled. .
21.2 The acceptance of a subscription shall be deemed as a contractual
agreement between the client and Net-Portfolio. A subscription paid for via Pay Pal will set up an automatic renewal, this is displayed in the Pay Pal terms before you accept payment. This automatic yearly subscription can be cancelled at any time through
your pay pal interface or by emailing us directly at admin@net-portfolio.com . For those that pay via other means such as cheque, bank wire transfer, postal order etc no automatic renewal is created.
21.3 All
material, both text and images, supplied by the
customer and used in the construction of the customer's portfolio, will remain
the customer's property. All such material will be assumed to be the property
of the customer and free to use without fear of breach of copyright laws.
21.4 The
copyright for all material provided by Net-Portfolio, such as HTML code,
graphics, photographs and text, will remain the property of Net-Portfolio.
21.5 If
at any point a customer wishes to cancel their subscription, they may do so but
will not be refunded. The customer’s account will remain at the level purchased
until the end of the subscription date, and then unless another subscription is
purchased, will become a free bronze level account.
21.6 If
the customer wishes to have their account removed and is on a paid membership
level, the subscription shall be cancelled and following the terms above shall
not be refunded.
21.7 Memberships
paid via delayed payment types such as ‘paypal echeque’ may be held at the companys
discretion until the funds have cleared. At which time the subscription level
shall be activated.
21.8 If a member breaches any
of the sites Terms and Conditions including the Site Rules which leads to account suspension or banning
and the member holds a premium level membership the paid membership will not be refunded.
22 Subscription Upgrades
22.1 In
the event of a member upgrading the current subscription level, if premium,
will be refunded to account for the time remaining unused on that subscription.
This will start from the end of the current month regardless of the point in
the month that the upgrade took place. For example if you upgrade on the 15th
September and this level expires in December, you would be refunded for October
to December at the current levels rate divided across the months cost. The new
level will then be charged at the normal rate for the annual level. This refund
will not be given until payment for the new level has cleared.
